Article VII - Property
  Section 1
The church may buy, sell, lease, pledge, own, and operate property, both real and personal, as may be necessary or advisable to carry out its purposes as set forth in Article II.

 

In the event the church shall for any reason be divided, the property and all funds of the church shall remain in the possession of those abiding by this Constitution.

  Section 2
Title to all real property owned, acquired or received by the church shall be taken in the corporate legal name of the church, and shall be wholly owned by the church corporation.  Any property shall be conveyed (bought or sold) in the corporate legal name of the church only by a deed executed on behalf of the church by the Elders and Deacons, duly authorized according to this document.

 

The purchase, sale, lease, or exchange of any real property owned by the church shall be authorized in the following manner:

 

The Board of Elders shall adopt a resolution recommending the purchase, sale, lease, or exchange to the church congregation.  The eligible voting members shall vote on the matter at a regular special meeting of the members called for the purpose of acting on this item.

 

Notice of this meeting and its purpose shall be given according to the provisions set forth in this document for the calling of any meeting.

 

The action must be approved by a vote of 2/3’s in favor, by the members present entitled to vote, in person or by proxy.

 

A deed, deed of trust, mortgage, bill of sale or other written instrument conveying or transferring property, or a contract agreeing to do so, or creating a lien, when properly authorized, shall be executed on behalf of the church by the Church Chairman and the Church Treasurer.

Article VIII - Amendments
  This Constitution may be amended only at the Annual Business Meeting of the church, and only by at least a two-thirds majority of the votes cast. The amendments must be presented to the congregation in written form at least thirty days prior to the Annual Meeting.
